ALTERNATIVE DISPUTE RESOLUTION (ADR)

Alternative dispute resolution (ADR), describes a variety of ways of solving a consumer problem or dispute without having to go to court. The principle forms of ADR are mediation, arbitration, adjudication, and conciliation. These are confidential and cost-effective methods of dispute resolution and dispute avoidance for civil and commercial cases.

The difference or dispute is likely to centre on a failure by one person to perform legal duties owed to another, which harm the legal interests of that other person. Some rights are inherent, such as personal safety; ownership of property; personal integrity and reputation, while other rights arise out of agreements.

The principal categories of civil dispute involve claims founded in the law of contract; the law of tort, which is concerned in particular with accidents and professional negligence; breaches of trust; and the redistribution of shared property following the breakup of relationships.
